Myth v. Reality: Mothers of Children of Tender-Years Will Get Custody

Mothers gaining custody of children of “tender years”, simply by virtue of the belief that young children need their mother is a concept that started to fade from the law over 50 years ago.  Today, most jurisdictions believe that children benefit most by having a relationship with both parents.  Some jurisdictions have even gone as far as to have created a presumption of 50/50 custody. Taking many factors into consideration, mediators will assist the parents in creating a realistic co-parenting schedule that best suits their family.
